1. Introduction
These Terms and Conditions govern the use of CPDCert.co.uk (the “Service”).
The Service is owned and operated by Andrew Slater, a UK-based sole trader (“I”, “me”, “my”).
By accessing or using CPDCert.co.uk, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Service.
2. Definitions
- Service – the CPDCert platform and website
- Organisation – a business or entity using CPDCert to manage CPD events
- User – an authorised representative of an Organisation
- Attendee – an individual registering attendance at a CPD event
- CPD Certificate – a digital certificate generated by the Service
3. Eligibility
You must:
- Be at least 18 years old
- Have authority to act on behalf of an organisation (where applicable)
- Provide accurate and complete information
Use of the Service is limited to lawful professional CPD purposes only.
4. Service description
CPDCert provides tools to:
- Create and manage CPD events
- Register attendance (including QR-based registration)
- Record quiz-based CPD where applicable
- Generate and email CPD certificates
- Maintain CPD audit records
The Service does not verify or accredit CPD content. Responsibility for CPD compliance rests with the Organisation.
5. Accounts and security
Organisations are responsible for:
- Maintaining the confidentiality of login credentials
- Ensuring only authorised users access the platform
- All activity carried out under their account
I am not liable for unauthorised access resulting from compromised credentials.
6. Responsibilities of organisations
Organisations using CPDCert agree that they:
- Are the data controller for attendee personal data
- Have a lawful basis to collect attendee information
- Are responsible for the accuracy of event details
- Are responsible for determining CPD eligibility and compliance
- Are responsible for issuing certificates appropriately
CPDCert acts as a technical platform only.
7. Responsibilities of attendees
Attendees are responsible for:
- Providing accurate personal information
- Ensuring their details are correct before certificate issuance
- Retaining copies of their CPD certificates for their own records
Certificates are generated based on submitted data and may not be altered after issuance.
8. Certificates
- Certificates are generated electronically
- Once issued, certificates are immutable
- CPDCert does not guarantee acceptance of certificates by any regulator or professional body
- Organisations are responsible for ensuring certificates meet their regulatory requirements
9. Quiz-based CPD events
For quiz-based CPD events:
- Only one attempt is permitted unless explicitly stated otherwise
- Quiz results are final once submitted
- Certificates may only be issued where pass criteria are met
- Attempts are recorded for audit purposes
10. Email delivery
The Service includes automated email delivery of certificates and system messages.
I do not guarantee email delivery due to factors outside my control (for example spam filters or incorrect email addresses).
Organisations should advise attendees to check spam or junk folders.
11. Service availability
The Service is provided on an “as available” basis.
While reasonable efforts are made to maintain availability, I do not guarantee uninterrupted or error-free operation.
Maintenance, updates, or unforeseen issues may result in temporary downtime.
12. Data protection
Personal data is handled in accordance with the Data Protection & Privacy Policy, which forms part of these Terms.
By using the Service, you confirm that you have read and understood the Privacy Policy.
13. Suspension and termination
I reserve the right to:
- Suspend or terminate access where these Terms are breached
- Disable accounts involved in misuse or unlawful activity
- Archive or delete data where required by law or policy
Organisations may request account closure at any time, subject to legal and audit retention obligations.
14. Fees and payment (if applicable)
Where fees apply:
- Fees are payable within 30 days of date of invoice
- Fees are non-refundable except where required by law
- Pricing may change with reasonable notice
15. Limitation of liability
To the maximum extent permitted by law:
- I am not liable for indirect, consequential, or economic losses
- I am not liable for regulatory decisions made by third parties
- I am not liable for incorrect data supplied by organisations or attendees
Total liability shall not exceed the fees paid for the Service in the preceding 12 months.
Nothing in these Terms limits liability for fraud or death or personal injury caused by negligence.
16. Indemnity
Organisations agree to indemnify and hold harmless Andrew Slater against claims arising from:
- Misuse of the Service
- Incorrect CPD information
- Breaches of data protection law by the Organisation
- Regulatory or professional disputes relating to CPD content
17. Intellectual property
All intellectual property rights in CPDCert, including software, design, and branding, belong to Andrew Slater.
No rights are granted except as necessary to use the Service.
18. Third-party services
The Service may rely on third-party providers (such as cloud hosting or email services).
I am not responsible for failures caused by third-party services beyond my reasonable control.
19. Governing law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
20. Changes to these terms
These Terms may be updated from time to time.
Continued use of the Service after changes are published constitutes acceptance of the updated Terms.
